FlatX – Combined Terms and Conditions for Property Owners (Residential & Commercial)
These Terms and Conditions ("Terms") govern the use of FlatX's platform and services by property owners ("You" or "Owner"). By listing your residential or commercial property on FlatX, you agree to comply with these Terms.
Service Overview
FlatX is an AI-based online room rental platform that connects property owners directly with tenants. Our platform provides owners with tools to list their properties, communicate with tenants, and manage bookings. FlatX does not act as a broker and does not guarantee tenant behavior or rental outcomes.
Owner Eligibility
To list a property on FlatX, the owner must:
- Be the legal owner or authorized representative of the property.
- Provide accurate and truthful information.
- Comply with all local, state, and national laws governing rental properties.
Property Listing Requirements
- Provide complete and accurate details (location, size, amenities, rental price, deposit, availability).
- Upload authentic photos or videos, including 360-degree videos if available.
- Mention any restrictions (e.g., no pets, no smoking).
- Ensure the property is habitable and safe for occupancy.
- FlatX reserves the right to modify, reject, or remove listings that violate these Terms.
Tenant Screening and Communication
- FlatX facilitates communication and does basic Aadhaar or PAN verification.
- Owners should independently verify tenant identity and employment.
- Communications must follow FlatX’s Community Guidelines—no abusive or discriminatory language.
Deposit Collection and FlatX Charges
- Once a tenant selects your property, the security deposit can be paid either directly to the owner or to FlatX on behalf of the owner.
- If the deposit is paid to the owner, the owner must pay the FlatX service fee on the same day of receiving the deposit:
- 30% of the deposit for Residential Properties.
- 50% of the deposit for Commercial Properties.
- If the deposit is paid to FlatX, FlatX will deduct its service fee and transfer the remaining amount to the owner within a reasonable timeframe.
- Owners agree not to collect any additional charges outside the platform for services provided through FlatX.
- The service fee is non-refundable under all circumstances, except in cases of technical errors explicitly acknowledged by FlatX.
Owner Responsibilities
- Keep the property clean, maintained, and defect-free at the time of handover.
- Provide timely possession on the move-in date.
- Abide by the rental agreement and return the tenant’s security deposit after deductions, if any.
- Promptly report disputes or issues to FlatX.
FlatX’s Liability
- FlatX is a facilitator, not a party to the rental agreement.
- FlatX is not responsible for tenant behavior or disputes.
- Liability is limited to the service fee collected.
Cancellations and Refunds
Owner-Initiated Cancellations:
- Full deposit must be refunded to the tenant within 7 business days.
- FlatX's service fee remains non-refundable.
- Repeated cancellations may lead to suspension.
Tenant-Initiated Cancellations:
- FlatX’s service fee is non-refundable.
- The remaining deposit will be refunded as per the booking cancellation policy.
Post-Stay Refunds:
- Owners must refund the deposit minus any valid deductions.
- FlatX’s service fee (30% for residential / 50% for commercial) is non-refundable.
Prohibited Activities
- List unauthorized or fake properties.
- Provide false property information.
- Take payments directly from tenants outside FlatX.
- Discriminate or violate tenant rights.
- Bypass FlatX by finalizing deals with leads generated on the platform.
Dispute Resolution
- FlatX may assist as a neutral mediator in disputes but does not guarantee resolution.
- Owners agree to act in good faith.
Account Suspension or Termination
- Terms or laws are violated.
- Fraudulent or abusive conduct occurs.
- Multiple complaints remain unresolved.
Amendments to Terms
- FlatX may modify these Terms at any time.
- Continued use implies acceptance of changes.
- Owners will be informed of major changes via email or platform notifications.
Governing Law
- These Terms are governed by Indian law.
- Any disputes shall fall under the exclusive jurisdiction of courts in Patna, Bihar.
